New Right of First Refusal and Repurchase: Expansion and Legal Updates.
The Generalitat has expanded the right of first refusal and repurchase under Decree Law 2/2025, especially affecting transactions involving properties in designated high-demand residential market areas.
Who is affected?
- When a large property holder (legal entity) sells a property in these areas.
- In cases of properties awarlded via administrative or judicial auctions.
Exceptions:
This right does not apply if the buyer is an individual who:
- Is registered in the protected housing register.
- Applies for protected housing status within one month.
- Commits to using the property as their primary residence for at least 10 years. (Failure to comply allows the Generalitat to exercise the right of repurchase).
New Rgister of Large Property Holders:
A specific register for large property holders is being established. Until the regulations are approved, holders must provisionally notify their status to the Housing Agency.
